These Terms and Conditions govern your use of the Insan Counsel website and any engagement of our legal services. By using this website or instructing us to act, you agree to these terms. If you do not agree, please refrain from using the website or engaging our services.
1. Definitions
- "Agreement" means these Terms and Conditions together with any signed engagement letter or fee agreement.
- "Service" means the legal advisory and estate administration services provided by Insan Counsel.
- "We / Us / Our" means Insan Counsel, a legal practice registered in Malaysia.
- "You / User" means any person accessing this website or engaging our services.
- "Content" means all text, documents, materials, and information on this website.
- "Engagement" means a formal instruction to act, confirmed in writing.
2. Acceptance of Terms
By accessing this website or contacting us with an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Use of this website constitutes acceptance of these terms.
3. Services Provided
Insan Counsel provides inheritance and estate legal services in Malaysia, including:
- Family estate consultations covering wills, Faraid distribution, and estate planning
- Probate and letters of administration applications and full estate administration
- Generational family estate counsel — long-term advisory engagements
Services are provided from our Kuala Lumpur office and are primarily directed at individuals and families in Malaysia. Enquiries from outside Malaysia are accepted, but the practice operates under Malaysian law.
4. Engagement of Legal Services
A legal engagement is formalised only upon:
- Receipt of a signed engagement or fee agreement from the client; and
- Payment of any required initial fee or deposit as specified in that agreement.
Submission of a website enquiry form does not, in itself, constitute the formation of a solicitor-client relationship. Advice given during an initial consultation is subject to the terms of the fee agreement for that session.
5. Client Responsibilities
In engaging our services, you agree to:
- Provide accurate and complete information relevant to your matter
- Notify us promptly of any change in circumstances that may affect the matter
- Respond to requests for information or instructions within a reasonable time
- Refrain from providing false, misleading, or fraudulent information
- Comply with all applicable Malaysian laws in connection with your estate matter
6. Fees and Payment
All fees are denominated in Malaysian Ringgit (MYR) and are set out in the fee agreement provided before work commences. Current indicative fees are:
- Family Record and Estate Consultation: RM 265 per session
- Probate, Administration and Distribution Counsel: RM 720
- Generational Family Estate Counsel: RM 1,410
Payment is due as specified in the fee agreement. We accept bank transfer and other payment methods as agreed. We do not provide refunds on completed sessions or work already undertaken, except where required by the rules of the Malaysian Bar.
7. Confidentiality
All information shared with us in the context of a legal engagement is subject to solicitor-client privilege and our professional obligations under the Legal Profession Act 1976. We will not disclose client information to third parties except as required by law, court order, or with your explicit consent. This obligation survives the termination of any engagement.
8. Intellectual Property
All content on this website — including text, design, and materials — is owned by or licensed to Insan Counsel. You may view and print content for personal, non-commercial reference only. You may not reproduce, distribute, or use any content from this website for commercial purposes without our written permission.
9. Disclaimers
The information on this website is provided for general informational purposes only and does not constitute legal advice. It does not create a solicitor-client relationship. Legal advice is provided only within the context of a formal engagement.
We do not make any representation that outcomes in your matter will be consistent with outcomes in other matters we have handled. Estate administration is subject to factors outside our control, including court processing times, third-party responses, and family circumstances.
10. Limitation of Liability
To the extent permitted by Malaysian law, our liability to you in connection with services provided is limited to the fees paid for those specific services. We are not liable for indirect, consequential, or special damages. Nothing in these terms limits liability for fraud, negligence, or conduct that cannot lawfully be excluded.
11. Termination
Either party may terminate an engagement by written notice. We may decline to accept or continue an engagement in circumstances permitted under the professional conduct rules of the Malaysian Bar. Upon termination, we will take reasonable steps to protect your interests, including notifying you of any urgent deadlines.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of Malaysia. Any dispute arising under these terms or in connection with our services will be subject to the exclusive jurisdiction of the courts of Malaysia, with the Kuala Lumpur High Court being the primary forum. We encourage parties to seek resolution through direct communication before initiating formal proceedings.
13. General Provisions
- Entire Agreement: These terms, together with the engagement letter, constitute the entire agreement between us in relation to the subject matter.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it subsequently.
- Assignment: You may not assign your rights under any engagement without our written consent.
14. Changes to These Terms
We may update these terms from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of this website following any update constitutes acceptance of the revised terms.
