What happens during the initial estate consultation?
The first session is private and unhurried. We review the family's circumstances, discuss the scope of the estate, and address questions about wills, distribution under civil or Faraid principles, EPF and insurance nominations, probate processes, or any related matters. You will leave with a written summary of the session.
What is the difference between probate and letters of administration?
Probate is the court-approved process to verify and execute a valid will. Letters of administration are granted when no valid will exists, allowing an administrator to manage and distribute the estate. Both processes involve the Malaysian High Court and require careful preparation of supporting documents.
How long does estate administration typically take in Malaysia?
The duration varies depending on the complexity of the estate, the number of beneficiaries, and whether any disputes arise. Straightforward estates with a valid will may be resolved within several months. More complex matters, or those without a will, may take longer. We keep families informed throughout and work to minimise unnecessary delays.
Does Insan Counsel handle Faraid (Islamic inheritance) matters?
Yes. Our team works with both civil and Faraid inheritance principles. We understand the intersection of these frameworks within the Malaysian legal context, and advise clients on the applicable law for their specific circumstances, including hibah and inter-vivos transfer considerations.
What should I bring to my first consultation?
A copy of any existing will, identification documents, a general list of known assets (property, bank accounts, EPF, insurance policies), and any documentation related to prior estate matters. It is not necessary to have everything in order before coming — we are accustomed to working with families at the beginning of this process.
Are consultations confidential?
All client communications and estate details are held in strict professional confidence under solicitor-client privilege and the obligations of the Malaysian Bar. Family information shared during consultations is not disclosed to any third party without your explicit consent.
